How can I use a complaint form at an establishment or service?
Businesses and services are required to have complaint forms available for their customers or users. This document can be used to file complaints with the establishment if discrimination or a violation of rights has occurred.
In Spain, each autonomous community has its own specific regulations regarding complaint forms, but they tend to coincide in some aspects:
- They consist of different copies (a copy for the person making the complaint, for the person in charge of the establishment, and for the body authorized to process complaints and claims).
- The copy for the person making the claim usually includes instructions on how to complete and process the complaint, claim, or report.
- You can fill out the complaint form at the establishment and hand it in immediately, or do it later and send it electronically.
- The sheet must include:
- The identification details of the person making the complaint (full name, ID or passport number and address).
- A clear and concise explanation of the facts that motivated the complaint, specifying the place and date they occurred, and specifying what the complainant wants.
- Signature.
- A person responsible for the establishment must record the company's identification details and sign or stamp the copy of the person making the claim as having received it.
- Whenever possible, a copy of the documents or evidence that justify the claim must be attached.
- The maximum time to receive a response from the establishment is usually one month from the date the complaint is submitted.
- If, after this period, the establishment has not responded or the response is not satisfactory to the person, a copy of the complaint, a copy of the attached documentation and the establishment's response can be sent to the corresponding body (depending on the scope of the complaint and the establishment, this body may be the Municipal Consumer Information Office - OMIC , the Regional Directorate General for Consumer Affairs , etc.).
