How can I exercise my right to confidentiality and privacy?

People with mental health problems have the right to have their privacy and intimacy respected. This is especially important in healthcare settings, where confidentiality is essential. What can you do to exercise this right?

  • Know your rights and remind yourself of them when necessary (you can cite the articles of the New York Convention).
  • Remember that your medical history is confidential and that you have the right to access it. If you are denied access, send a burofax with proof of receipt to the professional team. If you still do not receive it, contact the data protection agency in your territory, in Spain: Spanish Data Protection Agency .
  • If someone invades your privacy, let them know respectfully, explaining how you felt, and indicating how you would like them to act in the future.
  • If the center's organizational measures do not guarantee the right to privacy, contact the patient or user care services.
  • Create an opinion: openly discuss with colleagues, professionals, family members, etc. situations of violation of the right to privacy.
  • If it is a residential center, you can organize with the other residents to make a collective complaint and propose alternative measures.
  • Go to the user and family associations present in your area to get information and organize collectively.
